Website, practice and consumer purchase terms

The product page and checkout identify the content/service, price including applicable taxes, delivery, access duration, attempt limits and essential compatibility requirements. Read these before ordering. Adult purchasers, including parents, schools and homeschool organisers, can buy a resource for a child. Independent child purchasing is not the approved purchase route; this is separate from supervised participation and pupil results accounts. Competition participation and appropriately approved pupil accounts are separate activities.

An order is accepted when we send the order confirmation. If we cannot accept or fulfil it, we will tell you and return any payment collected. We provide the agreed product and a durable confirmation of the contract. Free resources do not require paid purchase or marketing agreement. Use resources within the personal/classroom licence stated on the product; do not resell or publish controlled materials without permission.

Cancellation and immediate supply

For consumer distance contracts you ordinarily have 14 days from the day after the contract is made to cancel, unless a lawful exception applies. To cancel, email info@bmsaq.com or write to the address above with a clear statement identifying the order. You may use the form below but do not have to. We refund eligible cancellation payments within the applicable legal deadline, normally 14 days after being informed, using the original payment method unless otherwise agreed, without a refund fee.

For digital content supplied without a physical medium, if you expressly request immediate supply and acknowledge in advance that you lose the change-of-mind right when supply begins, that right ends once supply begins. We confirm your request and acknowledgement with the order. Merely labelling something “non-refundable”, clicking a payment button or choosing not to download it is not that acknowledgement. Without the required agreement/confirmation, we do not rely on this exception.

For a service requested to start during the cancellation period, an appropriate express request is separate from the digital-content acknowledgement. Where the law permits and the required information/request was provided, an amount proportionate to service already supplied may be payable on cancellation. A service's cancellation right is not lost merely because it starts; any loss on full performance requires the legally required prior agreement. We do not apply the download exception automatically to online attempts or continuing services.

Problems, remedies and technical failures

Your statutory rights remain. Content/services must meet the contract and applicable standards. Tell us if they are faulty, inaccessible due to our supply, misdescribed or otherwise non-conforming. We will provide the applicable remedy, which may include repair, replacement, repeat performance, a price reduction or refund. Serious failures, failure to fix the issue within the applicable reasonable time, or other legal conditions can entitle you to a refund/price reduction without repeated replacement attempts. A paid attempt lost through a technical failure normally receives another attempt first, but that does not restrict your further legal rights. We ask for proportionate order details, not unnecessary pupil evidence.

Contact info@bmsaq.com for complaints. We do not exclude liability the law prohibits excluding. Northern Ireland law applies only so far as it does not deprive consumers of mandatory home-jurisdiction protections or court rights. The privacy notice explains information handling; marketing consent is optional and separate. These terms do not describe BMSAQ as an accredited exam board or its certificates as regulated qualifications.

Current checkout

Our current checkout does not collect the separate immediate-download acknowledgement described above. We therefore do not rely on that exception to remove a consumer’s change-of-mind cancellation right. Online attempts are treated separately from downloads.
