Organiser and Challenge terms

1. Agreement and authority

These terms govern organiser access and school/homeschool participation in BMSAQ Challenges. The supplier is Ben Patrick-James Mooney trading as BM Schools Academic Quiz, at 3 Desert Road, Newry, BT34 2JB, Northern Ireland, United Kingdom; info@bmsaq.com. The Challenge description, published dates, price and product-specific rules form part of the agreement. Terms apply prospectively from acceptance; we do not retroactively remove agreed rights.

The organiser must be an adult authorised to act for the school or participating homeschool children. School business purchasers act for their institution; a parent purchasing mainly for personal purposes may be a consumer and keeps applicable consumer rights. Individual pupils cannot act as organisers.

2. Verification and access

Registration starts pending verification. We aim to check authority within one working day but may need more information. Pending users may access public guidance and their own registration status, not controlled materials, school records, pupil results or staff permissions. Approved access is school-scoped. We may suspend access for an authority or security concern, explain the reason where safe and allow the organiser to supply appropriate evidence. Verification failure is not by itself an allegation of unlawful conduct.

Keep credentials confidential, use approved staff permissions and tell us promptly when staff leave or authority changes. Do not share organiser credentials with pupils or access another school's records. BMSAQ will verify replacement organisers through independent school contact; a person claiming to be a successor does not automatically inherit access.

3. Existing order rights

Keep the current product/order description and agreed regional pricing. Under the existing public order terms, entries can be added, reduced or cancelled before the relevant entry deadline, including paid orders; a reduction enters credit/refund review and is not an automatic card refund. After the deadline contact BMSAQ. These existing rights must be preserved when this expanded document is deployed; do not silently replace them with a narrower policy. Applicable consumer rights remain separate.

4. Fair participation and review

Follow the published Challenge-specific instructions, timing and permitted assistance. Use the correct pupil IDs, keep the ID mapping secure and report mistakes promptly. Agree access arrangements before participation where practicable. We will consider reasonable arrangements without demanding unnecessary medical information.

We may investigate suspected unfair participation or administrative errors. Before an adverse decision we will seek the relevant organiser's explanation where appropriate, consider the available evidence and explain the decision and review route. Request review at info@bmsaq.com promptly; we do not use a rule saying our decision eliminates statutory rights or privacy complaints. Certificates/results remain subject to correction of substantiated errors. A pupil account does not bypass the published result-release date.

5. Materials and service

Use supplied materials for the licensed Challenge or practice purpose described with the product. Do not distribute controlled question papers publicly or resell materials without permission. BMSAQ and its licensors retain their rights. Permission to use school names, logos, identifiable photographs or testimonials is separate from participation and must be documented before publication.

We take reasonable care in delivering the service. If a BMSAQ technical failure loses a paid attempt, we normally offer a replacement attempt promptly. This does not remove applicable rights to other remedies. If BMSAQ cancels a paid Challenge without delivering the contracted service or an agreed alternative, the applicable refund is available. Dates, features or prices are not changed retrospectively without a lawful basis and appropriate notice/agreement.

6. Data responsibilities

For competition design, answer marking, results and necessary official records, BMSAQ acts as an independent controller; schools act as independent controllers for pupil selection, their ID mapping and educational use. Each party is responsible for its own lawful basis, transparency, security and rights handling. Cooperate on corrections, incidents and requests without unnecessarily duplicating pupil information. BMSAQ's notice and family sheet describe its processing; the school must distribute them and explain its own activities. Health information requires a separate lawful condition and should be avoided wherever an adjustment can be arranged without it.

If BMSAQ provides a separately agreed service solely on the school's instructions, a separately agreed processing schedule applies only to that described service. It does not override the independent-controller activities above. Neither party may reuse the other's pupil data for unrelated advertising or AI training.

7. Orders, complaints and rights

The order identifies the customer, price including applicable taxes, service and fulfilment arrangements. Contact info@bmsaq.com with order or service issues. Consumer purchases also receive our website, practice and consumer purchase terms and the required cancellation information. No blanket non-refundable rule applies to faulty, inaccessible, misdescribed or otherwise non-conforming content/services.

Nothing excludes liability that cannot lawfully be excluded, including fraud, fraudulent misrepresentation or death/personal injury caused by negligence. Consumer statutory protections remain available. No financial liability cap is introduced in this draft without assessing the contract and insurance.

Northern Ireland law governs to the extent lawfully applicable. A consumer retains mandatory protections and court rights in their home jurisdiction where applicable, including Ireland; this clause does not force an Irish consumer to relinquish them. Try to resolve complaints with us, without limiting access to regulators or courts.
